Terms and conditions

Terms and Conditions of the vintagesounds.pl online store (hereinafter referred to as the 'Store')

Placing an order in the vintagesounds.pl store constitutes acceptance of the purchasing Terms and Conditions.

1. Purchase and shipment of products

The purchase agreement is concluded between the Customer and the company Vintage Box[1], which owns the Store.

Purchase of the products offered in the Store can be made:

- via the Store's website www.vintagesounds.pl by registering as a Customer or by ordering products without registration. We encourage you to register in the Store as this simplifies the procedure for subsequent purchases and enables order tracking and access to the purchase history. It also allows regular customers to take advantage of promotions

- by e-mailing an order to mail@vintagesounds.pl

- by calling 501 282 766

The key requirement to processing an order is the Customer providing correct contact details including a valid, existing e-mail address and phone number. Orders that have incorrect information (an incorrect or non-existent e-mail address, no phone number) will not be processed.

In most cases, the products offered on the Store's website are available immediately. In exceptional circumstances we will require 2-3 days to replenish our stock, in which case the Customer shall be informed forthwith.

Upon the Customer's confirmation of the purchase, information regarding payment details is sent to the e-mail address they provided. We will ship ordered items forthwith after the payment is credited to our account.

We do not offer a 'cash on delivery' option.

We send products ONLY via insured courier services. The cost of the shipment is given once the order has been completed.

Upon receipt of the shipment, the following must be checked in the presence of the courier:

- condition of the company security seal on the package (a broken seal may indicate that the package has been tampered with);

- completeness of the shipment

- condition of the products in the package (check for potential damage)

If the products are found to be mechanically damaged, a damage report must be prepared in the presence of the courier. This will constitute the basis for any returns or claims against the seller.

2. Product prices

The prices of the products provided in the Store are gross prices denominated in PLN and EUR. The Store reserves the right to change the prices of offered products at any time. The binding price for both parties to the transaction is the price shown next to the product at the time the Customer places the order. Shipping fees are added to the value of the order.

3. Faulty products. Complaints

All products available in the Store come from a legal source, are original and have a manufacturer's quality guarantee. If after receipt of the product the Customer finds manufacturing faults, they are entitled to exercise their warranty rights directly to the warrantor (manufacturer or distributor) or the rights they are entitled to from the seller on account of non-conformity of the product with the contract. To this end, a complaint must be filed (via e-mail to mail@vintagesounds.pl) describing the product's faults and when they occurred, after which the faulty product must be sent back to the address provided in the confirmation of receipt of the complaint. The complete product must be returned in its original packaging, with the original proof of purchase attached. The complaint will be considered within 14 (fourteen) days of the delivery of the returned Product to the Seller. The returned item may not be exchanged for another. The returned product is first fixed, to eliminate existing faults preventing proper use and operation of the product. In special cases, if the faults cannot be eliminated, the product may be replaced with a new one. Information on the outcome of the complaint will be addressed by the Seller to the Consumer's address provided when the complaint was filed. Subtle differences between the appearance of the delivered products and the ordered products, as seen on the Store's website, do not constitute grounds for complaint. These differences may be due to the settings (parameters) of the Customer's computer screen and/or imperfections in the graphics.

4. Right to withdraw from the contract. Returns

In accordance with the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by hazardous products, the Customer, being a natural person who makes a purchase for purposes unrelated to a business or economic enterprise, may withdraw from the contract without giving reasons within 10 days of delivery of the product. The Customer must submit a statement of withdrawal from the contract and return the complete purchased item to the Store (the product must have the original labels and tags attached, an must be in its original, undamaged packaging including protective film and other protective elements) and in non-deteriorated condition (the product must be fully functional and not bear any external signs of use such as mechanical damage, stains, scratches, etc.) with the original proof of purchase attached.

The Store must be notified of the decision to withdraw from the contract via e-mail: mail@vintagesounds.pl or by calling 501 282 766. The Store shall then send a product return declaration form to the e-mail address provided by the Customer. This form must be completed and attached to the product being returned. The returned product is to be sent back to the Store's address, as shown in the return information, within 14 days of withdrawing from the contract. The Store does not accept any ‘cash-on-delivery’ shipments. The cost of returning the product is not refundable. The Store agrees to refund the price of the returned product (the price of the product and the shipping fees) within 7 (seven) working days from the date of receipt of the returned product from the Customer. The refund will be transferred to the account number provided by the Customer in the product return declaration. The Store is not responsible for failure to refund or a delay in the refund if the Customer - in the product return declaration - does not provide the bank account number to which the funds are to be transferred, or if they do not provide the Store with all the information necessary to make the payment. The Store is not responsible for failure to refund or a delay in the refund if the Customer provides incorrect personal details (name, surname, address) or an incorrect account number.

5. Protection of personal data

By placing an order in the Store, the Customer agrees for their personal data to be placed in the Store's database and processed for the purposes of execution of the contract. The provision of personal data by the Customer is voluntary; however, a lack of consent for personal data to be processed prevents the Store from processing the order. The Customer is responsible for providing incorrect personal data.

Personal data is protected in accordance with the Act of 29 August 1997 on personal data protection (i.e. Journal of Laws of 2002 No 101, item 926, as amended) and the Act of 18 July 2002 on electronically supplied services (Journal of Laws No 144, item 1204, as amended) in a manner preventing access by third parties.

If the Customer provides additional consent, their personal data will be processed by the Store to notify the Customer about new products, promotions and additional services available in the Store.

The Store's Customers have the right to access their personal data, correct them and request their removal.

 7. Limitation of liability

The Store is not responsible for e-mail server administrators blocking messages sent to the e-mail address provided by the Customer, or for the deletion or blocking of e-mails by software installed on the computer used by the Customer. The Store is not responsible for transactions made by unauthorised third parties that gained access to the Customer's account as a result of the Customer failing to observe precautions as regards their account login and passwords.

 8. Final provisions

In all matters not covered herein, the provisions of Polish law, and in particular the Civil Code, the Act on the specific terms and conditions of consumer sale and amendments to the Civil Code (Journal of Laws of 2002 No 141, item 1176, as amended) and the provisions of the Act on the protection of certain consumer rights and liability for damage caused by hazardous products (Journal of Laws of 2000 No 22, item 271, as amended) shall apply.

The Store reserves the right to amend the Terms and Conditions. Any amendments to the Terms and Conditions come into force on the date indicated by the Store. Orders placed before the date of any amendments to these Terms and Conditions coming into force are processed pursuant to the provisions in force on the date the order was placed.
